Who is considered to be employed in the household?

They are those people who carry out domestic tasks, care or attention to people, or other functions such as childcare, gardening or driving vehicles. In all cases there must be a special employment relationship between the holder, such as employer, and the employee who provides the paid services within the family home.

The Special System for Home Employees

It is a Special Social Security System, integrated into the General Social Security System from 1 January to 31 December 2022*. From that date, the group is protected for temporary disability due to professional contingencies and for temporary disability due to common contingencies.

Improvements in working conditions and social security RDL 16/2022

Royal Decree-Law 16/2022, of 6 September, includes all the improvements in the working conditions and social security of workers serving the home. The main improvements of the new reform relate to unemployment protection, bonuses, accreditation of skills and identification of occupational diseases.

How to contribute to Social Security?

The household employee benefit is covered by social security contributions. If you provide your services for less than 60 hours per month for the same employer, you can agree that you will assume the obligation to contribute. In these cases, you will have to pay your contribution and the corresponding one to the employer.

Contribution types

  • Common contingencies: 28.30%, 23.60% corresponding to the employer and 4.70% to the employee.
  • Professional contingencies: 1.50%, to be paid by the employer.
  • Unemployment: 5% at employer’s expense.
  • Salary Guarantee Fund (FOGASA): 0.2% at the expense of the employer.

What economic benefits we covered?

  • Occupational accident and illness: From the day after the day of leave, we directly pay 75% of the regulatory base.
  • Leave due to common illness or non-occupational accident: Our healthcare staff
    monitors the leave of the Public Health Service. In the first three days there is no entitlement to the benefit. From the 4th to the 8th day, the employer will pay 60% of the regulatory base. Between the 9th and 20th day, we will pay you 60% of the regulatory base and 75% from the 21st.

  • Risk during pregnancy
    : If your job poses a risk to your health or that of the fetus, and you cannot continue to carry out your work, we pay you 100% of the regulatory base directly.
  • Risk during breast- feeding
    : If during the breastfeeding period your job may affect your health or that of the infant, we pay you 100% of the regulatory base directly.
  • Childcare : If you reduce your working day to take care of your children, or minors in your care, during the time of hospitalization and the continuous treatment of a serious and long-lasting disease, we pay 100% of the regulatory base, in proportion to the reduction of the working day.

  • Disabilities: If you have sequels after an occupational accident or occupational disease, we pay the compensation and pensions recognized by the National Institute of Social Security.

    • Partial permanent disability, total or absolute
    • Major Invalidity

How do I sign up for Social Security?

The employer has an obligation to register you with Social Security. However, if you provide your services for less than 60 hours per month for the same employer, you will have to deal directly with your affiliation, registration, cancellation and variation of data, when you agree with them.
